Proposed Amendment of Section 200.5 of the Regulations of the Commissioner of Education Relating to Special Education Due Process System Procedures

• At their July 2024 meeting, theÌý proposed an amendment to section 200.5 of the Regulations of the Commissioner of Education relating to special education due process hearings.ÌýThe proposed regulatory language is amended to clarify the kinds of disputes that fall outside the scope of the State entitlement to an impartial due process hearing.
• Beginning July 31, 2024, you are invited to provide comment regarding the proposed action.ÌýÌýSubmit comments toÌýChristopher Suriano, Associate Commissioner, Õý°ÄÃÅÁùºÏ²Ê¼Ç¼×ÊÁÏ, Office of Special Education, Room 301M, Education Building, 89 Washington Avenue, Albany, NY 12234 and/or email to REGCOMMENTS@nysed.gov. ​
• Comments must be received by the Õý°ÄÃÅÁùºÏ²Ê¼Ç¼×ÊÁÏ on or before October 21, 2024.
• It is anticipated that the proposed amendment will be presented for permanent adoption at the November 2024 Regents meeting.
